A efetividade da realização da segurança jurídica pela atividade das serventias extrajudiciais

Abstract

O presente estudo objetiva discutir a Efetividade da realização da segurança jurídica pela atividade das serventias extrajudiciais. Para tanto, aborda os registros públicos em uma acepção histórica, seus princípios, regulamentação e inovações legislativas; expõe os instrumentos garantidores da segurança jurídica com vistas ao desenvolvimento do país e para a redução do Custo Brasil; e defende a realização da segurança jurídica da atividade extrajudicial como saída legítima para a solução dos conflitos. A pesquisa se desenvolve por meio da análise bibliográfica de títulos nacionais e estrangeiros acerca da segurança jurídica dos registros públicos, mediante a leitura de livros, revistas, artigos e publicações avulsas pertinentes ao tema. Também é feita uma análise crítico-construtiva acerca da realização da segurança jurídica da atividade extrajudicial como saída legítima para a solução dos conflitos. Ao final do estudo conclui-se que a utilização das serventias extrajudiciais como instrumento efetivo e fomentador dos processos de desjudicialização, ressaltando sua característica de centros irradiadores de segurança jurídica, acaba contribuindo sobremaneira para o aumento da confiança e, consequentemente, reduzindo o custo das transações e do tráfego negocial em nosso País. Por fim, os atributos que envolvem as serventias extrajudiciais demonstram que ainda podem ser melhor exploradas pelo Poder Público dentro desse processo de desjudicialização, na busca de promover a desobstrução do Poder Judiciário, prevenindo futuros litígios e permitindo uma utilização mais ampla das serventias em prol da redução dos conflitos e da pacificação social.

This study aims to discuss the effectiveness of the realization of legal security by the activity of extrajudicial services. Therefore, it addresses public records in a historical sense, its principles, regulations and legislative innovations; exposes the instruments that guarantee legal security with a view to the development of the country and to the reduction of the Brazil Cost; and defends the realization of the legal security of the extrajudicial activity as a legitimate solution for the solution of conflicts. The research is developed through bibliographic analysis of national and foreign titles about the legal security of public records, through the reading of books, magazines, articles and separate publications pertinent to the subject. A critical-constructive analysis is also carried out regarding the realization of legal security in the extrajudicial activity as a legitimate solution for the solution of conflicts. At the end of the study, it is concluded that the use of extrajudicial services as an effective instrument and promoter of the processes of dejudicialization, emphasizing their characteristic of radiating centers of legal security, ends up contributing greatly to the increase of trust and, consequently, reducing the cost of transactions and business traffic in our country. Finally, the attributes that involve the extrajudicial services demonstrate that they can be better explored by the Public Power within this process of dejudicialization, in the search to promote the clearance of the Judiciary Power, preventing future disputes and allowing a broader use of the services in favor of the reduction of conflicts and social pacification,
