Litígios estruturais: a solução dialogada

Abstract

O presente estudo examina a possibilidade de obtenção de maior efetividade na concretização dos direitos sociais prestacionais quando o Poder Judiciário é instado a intervir, mediante a aplicação de parâmetros do processo estrutural, com dialogicidade com os demais Poderes, Instituições e sociedade civil. Tal efetividade é analisada sob o ponto de vista da obtenção de uma solução para além do conflito específico submetido ao Poder Judiciário, com a modificação da situação dos demais beneficiários do direito social sob demanda. Para tanto, além da revisão bibliográfica acerca do tema, com o estudo teórico do litígio, do processo e da decisão estruturais, examina-se ação civil pública movida em face da Municipalidade de São Paulo, em cujo processo é possível aferir-se parâmetros dessa teoria estruturante, a fim de perscrutar se as métricas nele utilizadas e o diálogo estabelecido entre o Poder Judiciário, o Poder Executivo e os demais interessados na questão implicaram resultados empíricos mais efetivos em termos de melhoria coletiva da situação da população destinatária do direito social nela debatido.

The present study examines the possibility of obtaining greater effectiveness in the realization of the social benefits provided when the Judiciary Power is urged to intervene, through the application of parameters of the structural process, with dialogicity with the other Powers, Institutions and civil society. Such effectiveness is analyzed from the point of view of obtaining a solution in addition to the specific conflict submitted to the Judiciary, with the modification of the situation of the other beneficiaries of social law on demand. Therefore, in addition to the bibliographic review on the subject, with the theoretical study of the structurals litigation, process and decisions, a public civil action filed against the Municipality of São Paulo is examined, in which process it is possible to assess parameters of this structural theory, in order to to examine whether the metrics used in it and the dialogue established between the Judiciary, the Executive Branch and the other interested parties in the matter implied more effective empirical results in terms of collective improvement of the situation of the population addressed by the social law discussed therein.
