Usos e abusos da teoria do Poder Constituinte na América Latina: um estudo sobre Brasil e Venezuela a partir do Direito Constitucional Comparado

Abstract

O trabalho busca fazer uma revisão sistemática da literatura constitucional tanto nacional quanto internacional, buscando entender se a teoria tradicional constitucional ainda é adequada para pensar a elaboração de Constituições, utilizando como parâmetro histórico-factual os acontecimentos da Ditadura Militar no Brasil e do governo Chavez na Venezuela. Este trabalho apresenta uma análise comparativa entre teorias constitucionais tradicionais e contemporâneas buscando mostrar a necessidade de se repensar as discussões sobre Poder Constituinte, criação de Constituições e legitimidade democrática das Constituições. A presente pesquisa é baseada na revisão de bibliografias de diversos juristas, buscando mostrar as críticas a teoria tradicional. Verificou-se que muitos dos acontecimentos no Brasil e na Venezuela se deve desconexão entre a teoria constitucional tradicional e a legitimidade do Poder Constituinte e a Democracia, exatamente onde a teoria contemporânea irá fundamentar suas críticas. A partir das conclusões obtidas através desta revisão bibliográficas pode-se entender que de fato as discussões sobre Poder Constituinte e teoria constitucional precisam ser resgatadas observando os paradigmas da legitimidade constitucional e sempre se atentando ao fato de que as Constituições são sinônimos a Democracia respeitando as garantias e direitos individuais

This paper seeks to make a systematic review of the constitutional literature both nationally and internationally, seeking to understand whether traditional constitutional theory is still adequate to think about constitution-making, using as a historical-factual parameter the events of the Military Dictatorship in Brazil and the Chavez government in Venezuela. This paper presents a comparative analysis between traditional and contemporary constitutional theories seeking to show the need to rethink the discussions on Constituent Power, constitution-making and democratic legitimacy of constitutions. The present research is based on the revision of bibliographies of several jurists, seeking to show both the evolution and the criticism to the traditional theory. It was verified that many of the events in Brazil and Venezuela are due to the disconnection between the traditional constitutional theory and the legitimacy of the Constituent Power and Democracy, exactly where the contemporary theory will base its criticism. From the conclusions obtained through this literature review, one can understand that in fact the discussions about Constituent Power and constitutional theory need to be rescued observing the paradigms of constitutional legitimacy and always paying attention to the fact that the Constitutions are synonymous with democracy respecting the guarantees and individual rights.
